When Paco Briones<\/strong> was younger, in Tulancingo, Hidalgo, the access to drugs and substances was very restricted. In addition, people tended to be very moralistic. When he came to UNAM to study economics, he tried cannabis for the first time. For Paco, that was an incredible experience. It changed the way he saw and understood reality.<\/p>\n

Several years before, he could talk openly with his family about his consumption. It bothered him a lot to have to buy cannabis always in the illegal market, so he decided to grow his own and started with a plant without knowing anything about it. When he entered law school, he learned that there was a legal way to grow marijuana.<\/p>\n

In Mexico, the Constitutional Court declared in 2018 that the prohibition and criminalization of recreational cannabis consumption are unconstitutional, as it goes against the right to free development of personality. However, to cultivate and consume it, it is necessary to have a special permit. Before this declaration, this permit was granted to those who used cannabis for medicinal purposes only. There was a background in the case of Graciela or Grace, a girl who suffered from Lennox-Gastaut syndrome, which caused her to suffer a high number of daily epileptic seizures, and whose best treatment was cannabidiol or CBD, one of the 113 cannabinoids present in marijuana.<\/p>\n

With his knowledge of the law, Paco initiated the permit application before the Cofepris. Like so many others, he received no response. So Paco took his case to Court and is waiting to receive an amparo<\/em>, a document that allows him to grow up to 8 plants in his home and process them. With all the initiated legal processes, he now has a way to defend his crop and business. Because he and his family started ToQe, an intergenerational cooperative in which they produce CBD tinctures and combine them with tinctures from other plants, whose effects are traditionally known in Mexican herbal medicine. Paco’s mother, his partner, and their daughters work at ToQe. Together they take care of the plants, harvest what is necessary to produce the tincture, dry them together and then process them.<\/p>\n

Mrs Lucy, Paco’s mother, went from thinking that any approach to the plant would harm her and turn her into a ‘marijuana’ to recognizing all the medicinal properties it has and benefiting from them. Paco’s daughters grow up without prejudice towards a plant and recreational consumers. For Paco, that has been one of ToQe’s most significant impacts.<\/p>\n

How did ToQe start?<\/strong><\/p>\n

I have used cannabis recreationally, and after a few years, I decided to learn how to grow it so I wouldn’t keep buying it. I didn’t particularly appreciate doing it. When I entered law school, I realized that I had the right to apply for a permit to grow cannabis plants for my consumption. I realized that by that time, in 2019, many people had already achieved their amparo, to be able to self-cultivate. The legal precedent is the case of Grace<\/a>, a girl who suffered from Lennox-Gastaut syndrome; she had many epileptic seizures a day. In 2009, the Supreme Court of Justice decided to give Grace’s family permission to import a CBD-based medicine. That allowed us to achieve legal crops. In 2018, the Supreme Court declared unconstitutionality the criminalization of recreational cannabis consumption. It opens the possibility of requesting a permit before the Cofepris for self-cultivation for personal consumption.<\/p>\n

I requested my permit and never received an answer that immediately configured an institutional silence that allowed me to take the case before a Court of Administrative Justice that, in fact, already ruled in my favor. However, I requested an injunction that should be effective in 90 days. I point out that the Court cannot leave me in legal uncertainty and much less undermine, in this way, my rights to free development of personality and health.<\/p>\n

My case shows that if a citizen had all the information available to them, they would have all the possibilities provided by the law. And with a bit of time, patience, and a little trust in the institutions, citizens can obtain those permits.<\/p>\n

So, it all started with the request for a permit for personal consumption. The idea of turning it into a family business arose during the pandemic. Faced with confinement, we began to look for economic possibilities. I am obsessive, so I started to study, and we developed a crop of 8 plants; that is, we respect the guidelines of the Cofepris. Ours is a sustainable and 100% organic crop, we produce medical cannabis, and all our plants are for it. We do not kill our plants. We only prune the flowers, which has made us have plants of up to 2 meters. We respect the natural cycles of cannabis, and in some cases, we have extra light.<\/p>\n

Le molestaba mucho tener que comprar el cannabis siempre en el mercado ilegal, as\u00ed que decidi\u00f3 autocultivar y empez\u00f3 con una planta sin saber nada de ella. Solo fue hasta que entr\u00f3 a estudiar derecho que se enter\u00f3 de que hab\u00eda un camino legal para sembrar marihuana.<\/span>\n\nEn M\u00e9xico la Corte Constitucional declar\u00f3 en 2018 que la prohibici\u00f3n y la penalizaci\u00f3n del consumo recreativo de cannabis es inconstitucional, pues va en contra del derecho al libre desarrollo de la personalidad. Sin embargo, hay una serie de vac\u00edos legales y para poder cultivar y consumir es necesario tener un permiso especial. Ese permiso hasta antes de esa declaratoria s\u00f3lo era otorgado para quienes usaran el cannabis con fines medicinales. Cuando entr\u00e9 a estudiar derecho aprend\u00ed que como ciudadano ten\u00eda derecho a solicitar un permiso para cultivar plantas de cannabis para mi consumo personal. Me di cuenta de que para ese momento, en el 2019, ya hab\u00edan muchas personas que hab\u00edan logrado su amparo para poder autocultivar. El precedente legal es el <\/span>caso de Grace<\/span><\/a>, una ni\u00f1a que sufr\u00eda el s\u00edndrome de Lennox-Gastaut, es decir, ten\u00eda muchos ataques epil\u00e9pticos al d\u00eda. En 2009, la Suprema Corte de Justicia resuelve darle un permiso a la familia de Grace para importar un medicamento a base de CBD. Eso nos dio la oportunidad de lograr cultivos legales. En el 2018 se hizo la declaratoria de inconstitucionalidad de la penalizaci\u00f3n de consumo recreativo de cannabis y se abri\u00f3 la posibilidad de solicitar el permiso ante la Cofepris para el autocultivo con fines de consumo personal.<\/span>\n\nYo solicit\u00e9 mi permiso y nunca recib\u00ed una respuesta, eso inmediatamente configur\u00f3 un silencio institucional que me permiti\u00f3 llevar el caso ante un Tribunal de Justicia Administrativa que de hecho ya fall\u00f3 a mi favor. Y que solo con un poco de tiempo, paciencia y un poquito de confianza en las instituciones se pueden lograr permisos como este.<\/span>\n\nEntonces, todo surgi\u00f3 a partir de la solicitud de un permiso para el consumo personal, la idea de convertirlo en una empresa familiar surgi\u00f3 en la pandemia. Ante la situaci\u00f3n del encierro empezamos a buscar posibilidades econ\u00f3micas. Yo soy obsesivo as\u00ed que me puse a estudiar y desarrollamos un cultivo de 8 plantas, es decir, respetamos los lineamientos de la Cofepris. El nuestro es un cultivo sustentable y 100% org\u00e1nico, producimos cannabis medicinal y todas nuestras plantas est\u00e1n destinadas a ello. Nosotros no matamos nuestras plantas, solo podamos las flores y eso ha hecho que tengamos plantas de hasta 2 metros. Respetamos los ciclos naturales del cannabis y en algunos casos tenemos luz extra.<\/span>\n\nPero entonces,  con el permiso que tienen \u00bfs\u00ed pueden comercializar?<\/b>\n\nS\u00ed, porque el 12 de enero del 2021 se public\u00f3 un decreto que permite la comercializaci\u00f3n de  hasta 500 miligramos CBD en M\u00e9xico. Nosotros hacemos tinturas, descarbolixamos la planta y hacemos todo un proceso artesanal. La planta de manera natural se va degradando, y va perdiendo efectos psicoactivos,  si no se carboniza no tiene efectos psicoactivos. Lo que est\u00e1 penalizado es el tetrahidrocannabinol (TCH), entonces no tenemos problemas. <\/span>\n\nHay una fuerte introducci\u00f3n de plantas modificadas gen\u00e9ticamente \u00bfQu\u00e9 variedades de plantas tienen ustedes? Pero adem\u00e1s de eso, en Colombia, por ejemplo, hay plantas que tienen luz d\u00eda y noche, la im\u00e1gen inevitablemente me hace pensar que se trata de plantas esclavas, \u00bfeso es as\u00ed o es puro prejuicio?<\/b>\n\nNosotros hemos experimentado con varios tipos de semillas locales. Ya hay una mercadotecnia y una moda, la industria ahora se dedica a traer semillas holandesas o canadienses. Es muy dif\u00edcil conseguir una Acapulco Beach verdadera, por ejemplo. Pero tampoco podemos ser tan puristas, el cruce de variedades es un proceso que hace parte de la naturaleza de la planta al ser dicotiled\u00f3nea. El problema es que ya tenemos industria como la del ma\u00edz, tipo Monsanto, en este caso es Buddha seeds.<\/span>\n\nEl problema de la industria es que es poco sustentable. Las plantas s\u00ed necesitan una cantidad de horas de luz y en nuestro caso la usamos, pero respetando el ciclo de vida de las plantas. Nosotros estamos desarrollando un m\u00e9todo, con la intenci\u00f3n de que luego otras personas tambi\u00e9n puedan aplicarlo.
